

Normal Weekly Working Hours: According to the Labor Law, a worker's normal weekly working hours are 45 hours. However, this can be specifically determined between the worker and the employer. If the agreed-upon weekly working hours between the worker and employer are less than 45 hours (e.g., 40 hours), the work done between this agreed time and 45 hours is referred to as "work with additional hours." Work exceeding 45 hours per week is referred to as "overtime."
Overtime Pay Rate: Workers who work overtime are entitled to 1.5 times their regular hourly wage. For work with additional hours (less than 45 hours but more than the agreed weekly hours), the pay is 1.25 times the regular hourly wage. However, if the worker prefers, they can use the equivalent time as time off instead—1.5 times for overtime and 1.25 times for additional hours.
Calculating Overtime Pay for Different Years: A worker's overtime pay may pertain to different years. Therefore, the calculation must be based on the wage applicable during each specific period. It would not be correct to calculate overtime pay based on the most recent wage. In this case, it is not sufficient to know only the worker's latest wage. The wages for each relevant period should be entered separately to calculate the overtime pay correctly.
